COPYRIGHT INFRINGMENT - FINES AND PENALTIES

My Work, defined in the definitions section, is intellectual property protected under federal copyright law. All of my Works are independently created and fixed in a tangible medium (e.g., recorded on a computer file or a piece of paper). All items in my portfolio, including my website, Facebook page, LinkedIn profile, text messages, emails, and other communications, belong solely to Squirrel Studios, held by Erika Powers.

Intellectual property is protected under Federal law. Theft of intellectual property is illegal and prohibited. Prosecution for stealing leads to fines and imprisonment.

Under the Digital Millennium Copyright Act, all content (written Work), albeit digital, print, or media, is protected under copyright law, regardless of having a copyright symbol.

Holders of copyrights generally have the exclusive right to reproduce, distribute, and prepare derivative works from them. The copyright does not expire for 70 years after the author's death.

Plagiarism is taking the writings of another and selling or publishing them as one's writing. The original author can bring a lawsuit for appropriating their Work against the plagiarist and recover the profits. Although not usually a criminal offense, a person who plagiarizes is subject to being sued for fraud or copyright infringement. Writing in which my exact words are merely rearranged is plagiarism.

Plagiarism is a second-degree misdemeanor, punishable under s. 775.082 or s. 775.083.

TRANSFER OF COPYRIGHT OWNERSHIP TO CLIENT

A $100 non-refundable deposit is required for all Works to begin. Balance is due immediately upon completion and client sign-off.

Squirrel Studios and Erika Powers retain the sole ownership of all Works until full payment clears. Then the Work becomes yours, and you own it and may use it how you wish.

Squirrel Studios and Erika Powers also retain the right to use Work after it transfers to you. I may use it in my portfolio, website, or other marketing materials to provide examples to my clients.
